POLICY
Introduction
ImpacCompanies.com (“Impac”) respects the privacy
of the users of its web site (“Users”), and is
dedicated to honoring their preferences regarding use and
disclosure of information collected while using the ImpacCompanies.com
web site and sub-sites accessible through their homepage (collectively
hereinafter the “Site”). Impac is continually
developing technology to enhance Site features and security,
and to provide Users with choices regarding information use
and disclosure. This Privacy Policy sets forth Impac’s
policies regarding collection, storage, access, use and disclosure
of information relating to a User’s application, registration,
use of the Site and communications with Impac. If you have

Updates to the Privacy Policy
Impac may update this Privacy Policy from time to time as
new features and services become available on the Site and
to keep pace with technological developments. Users are responsible
for checking this page periodically for changes and updates
to this Privacy Policy. Any change or update to this Privacy
Policy shall automatically be effective fifteen (15) days
after it is initially posted on the Site. The User’s
use of the Site following any posted and effected change will
be deemed an acceptance of such change.
Information Collection, Use and Disclosure
Activities
Registration Information: The
Site may permit Users to provide certain information, including
name, company, title, e-mail address, phone number, and mailing
address. Except as stated herein, this information will only
be used internally by Impac to operate the Site and to communicate
with Users. User-specific information will be made available
to other Users only to the extent specifically consented to
by that primary User. User registration information may be
transferred to a new owner if Impac is sold, merges, or ceases
operations.
Impac reserves the right to disclose any information if
such action is necessary (a) to conform to the requirements
of law or to comply with legal process or subpoena served
on Impac, (b) to protect and defend the legal rights or property,
including intellectual property, of Impac, theSite or its
Users, or (c) in an emergency, to protect the health and safety
of its Users or the general public. Impac further reserves
the right to release any information concerning any User if
that User participates (or is reasonably suspected of participating)
in any illegal activity, even without a subpoena, warrant,
or other court order. Finally, Impac reserves the right to
cooperate with law enforcement agencies in identifying those
who may be using our servers or services for illegal activities,
and to report any suspected illegal activity to law enforcement
agencies for investigation or prosecution, including sharing
information for fraud protection and the reduction of credit
risk.
Aggregated Information: Impac
may collect, use and disclose for marketing and other purposes
certain general, demographic and statistical information regarding
Site membership, transactions and usage as permissible by
law. Such information is aggregated prior to disclosure, and
will not include any personally identifying information specific
to a particular User or transaction.
Technical and Usage Information:
To operate the Site, enhance its functionality, and ensure
that User transactions and communications are convenient,
dependable and secure, Impac may collect, store and use technical
and Site usage information relating to a User’s activities
on the Site. Such information includes the Internet Protocol
(“IP”) address from which a User accesses the
Site, which is used only internally by Impac as required for
server operation and other technical uses, and is not disclosed
to Users or other persons.
User Communications and Marketing:
If a User consents in advance, Impac will use User contact
information, such as e-mail addresses, to communicate with
the User regarding available transactions, to notify the User
of changes in Site functionality and features, product and
service updates, patches, policy changes, billing and other
activities relating to a User’s use of the Site, and
for marketing purposes.
Agents: Impac may employ other
companies and individuals to perform functions on its behalf.
These other companies and individuals may be required to access
and use information provided by or about a particular User,
but may not use such information for other purposes. Users
hereby consent to such use and access for the performance
of such functions.
Partners: Impac may offer some
third-party services to its Users. If the User chooses to
use these optional services, Impac will, by necessity, provide
some of the User’s personal identifiable information
to the commerce partner offering such services. Users can,
of course, avoid having Impac make such disclosures by choosing
not to use these services. Because Impac does not control
the privacy practices of these third-parties, Users should
evaluate each party’s practices before deciding to use
the services that such party offers.
Consent of Customers: The Site
may be designed to allow the transfer and disclosure to Impac
of mortgage or other personal financial data of a particular
User’s customers. The User acknowledges that requests
for and transfer of such data which pertain to a particular
individual may subject the User and Impac to enhanced regulatory
scrutiny, including the privacy provisions contained in the
federal Gramm-Leach-Bliley Act, the federal Fair Credit Reporting
Act as well as state privacy and fair credit reporting laws
and regulations. The User will take all actions necessary
to ensure that each of User’s customers, prior to such
transfer or disclosure, is fully apprised of the extent of
such transfer or disclosure, and consents to such in advance.
Collection and Use of Information Using
‘Cookies’
Impac receives and stores certain types of information whenever
a consumer uses the Site. As with many state-of-the-art Internet
sites, the Site uses “cookies” to enhance the
functionality of the Site and to make transactions and other
activities more convenient and efficient for Users. A “cookie”
is a small text file stored locally on the computer used to
access the User’s account, and contains information
relating to a User’s past use of the Site. A number
of companies offer utilities designed to help a consumer visit
Sites anonymously. Although Impac will not be able to provide
Users with a personalized experience at the Site if Users
cannot be recognized, Impac wants Users to be aware that these
options exist. Disabling the use of “cookies”
on an Internet browser, however, may prevent a User from being
able to transact business on the Site.
Links to and From Other Web Sites
The Site may contain links to third-party web sites. These
linked sites are not under the control of Impac, and Impac
is not responsible for and cannot make any assurances regarding
the privacy, or other policies or practices of the operators
of such web sites. Such links are provided only for the convenience
of our Users. Impac makes no representation as to the accuracy
of the content of any linked site or any link contained in
a linked site. Impac incurs no liability for damages or expenses
suffered by any User in accessing and using such sites or
the content thereof. Impac is providing these links only as
a convenience to Users, and the presence of a link does not
imply endorsement or control of the linked site, its content,
or its operator, by Impac.
Any links to the Site from other web sites must (i) receive
prior approval in writing by Impac, (ii) link to the homepage
of the Site, (iii) not display the content of the Site within
a border or frame controlled by or displaying the content
of the linking page, and (iv) be promptly removed at the request
of Impac.
Security of User Information
Impac does not release commercial information related to
a specific transaction, User, or company to anyone without
prior written consent by all parties involved. Although Impac
takes all reasonable precautions to protect a User’s
information, due to the open nature of the Internet, Impac
cannot guarantee that any information stored on its servers,
or transmitted to or from Users will be free from unauthorized
access.
Restricted Access
In protecting a User’s communications with the Site,
Impac employs a security system whereby each user receives
a registration number and the User subsequently selects a
password in order to protect from unauthorized access by third-parties.
Impac attempts to employ the best security system available,
but, in accordance with the WEBSITE USER AGREEMENT, Impac
does not guarantee against unauthorized access and is not
liable for any consequences of such activity.
Consent to Processing
By providing any personal information to the Site, all Users,
including without limitation, Users in the European Union,
fully understand and unambiguously consent to the collection
and processing of such information in the United States.
